1. General

This term provides the rules for using the Agritempo web system available at: http://www.agritempo.gov.br

Embrapa Agricultura Digital and the Center for Meteorological and Climatic Research Applied to Agriculture (Cepagri), from the State University of Campinas (Unicamp), are the maintainers of the Agritempo web system.

Any individual or legal entity that freely accesses the system via the Internet is considered a User.

2. Purposes of the Agritempo System

The Agritempo Agrometeorological Monitoring System offers daily meteorological data and information on weather and climate for the entire Brazilian territory. The system is fed by data from more than 1,400 meteorological stations across Brazil, some of which belong to the system's partner institutions.

Agritempo provides agrometeorological bulletins, meteorological products presented in the form of maps, weather forecasts for the capital of each state, information on Agricultural Zoning of Climate Risks, and historical meteorological data, among other products.

3. Rights and Responsibilities

Embrapa Agricultura Digital and Cepagri/Unicamp

• Hold the intellectual property rights related to the content published on the Agritempo web system (in the form of processed data, texts, photographs, sounds, videos, maps, images, and graphical elements), as well as its software and associated brands, as established by the Brazilian Federal Government's Copyright Law No. 9.610, dated 02/19/1998, and related laws.
• Hold the intellectual property rights of the raw data they provide to the system.
• Present agrometeorological data and information in the Agritempo system in strict compliance with the scientific standards applicable to the subject.
• Exempt themselves from any responsibility, judicial or extrajudicial, for any damages, losses, or harm resulting from the use of agrometeorological data and information from the Agritempo system.

The maintainers have the right to, at any time, change or discontinue the System or any aspect or feature of the System, including its content and availability hours, without prior notice, except as required by law or as stated in these Terms of Use.

Are not responsible for any interruptions or failures in accessing the Agritempo system due to technical issues, nor for the content of third parties mentioned and hosted in the Agritempo system, especially in the news and publications sections on the site.

3.2 The User

Is responsible for providing their technological resources necessary for accessing the Agritempo system, being aware that the data presentation may vary depending on the web browser used to access the system, or the chosen configuration.

Is fully responsible for the data and information they enter into Agritempo and for how the system is used, bearing full responsibility for any inaccuracies of the data provided, thereby exempting the Agritempo maintainers from any liability related to acts resulting from their actions.

Commits to not infringing any third-party rights, including the intellectual property rights of the maintainers and of the partner institutions of the system, among other rights.

Is guaranteed the confidentiality of their data and their navigation in the system.

4. Use Restrictions

It is emphasized that:

Reproductions, storage, transmission, copies, distribution, or any other form of use for commercial purposes of the contents hosted on the system are prohibited, unless expressly permitted by Embrapa and Cepagri/Unicamp.

The republication and dissemination of public content are allowed, provided that the source, title, and author are cited. In the case of restricted content (such as raw data), its use without authorization from the holder(s) is not allowed.

The citation of the Agritempo system's URL (http://www.agritempo.gov.br) on third-party sites and pages is allowed.

5. Applicable Legislation

These Terms of Use are governed by the laws pertaining to the subject, especially the Industrial Property Law No. 9.279, dated 05/14/1996, and the Copyright Law No. 9.610, dated 02/19/1998, in the national territory, and the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS) at the international level.
